Temple-image in TN State emblem – is it against secularism?


In a significant judgement, the Madras High Court has dismissed a petition that wanted to get removed the image of the temple in the Tamilnadu State emblem. The judges refused to accept the plea that it was against secularism to have the image of the temple in the state emblem.

 

This emblem was introduced soon after Independence which by itself shows that until Independence Tamilians have considered the temple as an identity of the Tamil culture. But in half century thereafter, how views have changed! The 'secular' games played by Congress, the media and Karunanidhi had been instrumental in changing the nature of our culture that had been there from Sangam period onwards.

 

Today the judges have refused to see this image as non-secular,  but is there any guarantee that the people of coming years would say the same?  It is in this context I am writing this blog to show some proof from the past on how the Tamils belonging to Christianity and Islam considered Tamil and Hindu culture as dear to them. Everyone would have heard about Dr U.Ve.Swaminatha Iyer (1855-1942)  who was instrumental in restoring the Sangam texts and bringing them in print. His autobiography is a gold mine of information on the status of education in Tamil at his times. ( (it can be read here). From his narration it is learnt that Muslims studied Tamil works like Kamba Ramayana and Harichandra Purana and enjoyed the nuances of these texts.  His narration on some Muslims of a place called Kalathur who were experts in Tamil literature and who studied these texts in Tamil is given below.

 

Dr Iyer  had a colleague in his Gurukul who was a Roman Catholic. Known by the name  "Saveri Natha Pillai" this person was very much devoted to Tamil studies and enjoyed the Bhakthi poems of Tamil. The famous Meenakshi Sundaram Pillai was the teacher for both of them (Swaminatha Iyer and Saverinatha Pillai). The sthala purana of Thiru perum Thurai Shiva was written by the teacher and published in the temple. At that time Saverinatha Pillai was keen on reading out the text but was worried that his Christian name would hamper that. He requested his teacher to change his name and duly got named as "Siva Guru natha Pillai". He was elated at the change of name from his original Christina name. He lived like a Saivite and the credit goes to the essence of Tamil texts that he studied. The narration is also produced below.

 

By these I am showing that all the inhabitants of Tamilnadu were Hindus only. Though some of them converted to Christianity and Islam due to several reasons in the past, they continued to live and think as Tamils of Hindu culture and not as alien culture. It is by unfortunate turn of events in the lives of their forefathers that they lost Hindu identity. But until 1950s they lived as Tamil Hindus in mind and thought. That was the reason the image of the temple (of Srivilliputtur) came to adorn the emblem without any second thought or opposition.  Let no one forget this ever.

சில நாட்களில் அருகில் உள்ள ஊர்களுக்குச் சென்று முன்பே
பழக்கமானவர்களைப் பார்த்து வருவேன். ஒரு நாள் களத்தூருக்குச் சென்றேன்.
அங்கே தமிழ் படித்த முகம்மதிய வயோதிகர் சிலர் இருந்தனர். அவர்களோடு
பேசுகையில் அவர்களுக்கிருந்த தமிழபிமானத்தின் மிகுதியை உணர்ந்து
வியந்தேன். கம்பராமாயணம், அரிச்சந்திர புராணம் முதலிய நூல்களிற் பல
அரிய பாடல்களை அவர்கள் தங்கு தடையின்றிச் சொல்லி மகிழ்ந்தார்கள்.
பாடல்களை அவர்கள் சொல்லும்போதே அவர்களுக்கு அப்பாடல்களில்
எவ்வளவு ஈடுபாடு உண்டென்பது புலப்படும். நான் பிள்ளையவர்களிடத்தில்
இருந்ததை அறிந்தவர்களாதலின் என்பால் வந்து அவர்கள் மொய்த்துக்
கொண்டார்கள்; ஆசிரியர் புகழையும் கவித்துவ சக்தியையும் கேட்டுக் கேட்டு
மகிழ்ந்தனர். சாதி, மதம் முதலிய வேறுபாடுகள் அவர்களுடைய
தமிழனுபவத்துக்கு இடையூறாக நிற்கவில்லை. தமிழ்ச்சுவையை நுகர்வதில்
அவர்கள் உள்ளம் என் உள்ளத்தைக் காட்டிலும் அதிக முதிர்ச்சியைப்
பெற்றிருந்தது.

     'சிவகுருநாத பிள்ளை' 

எங்களுடன் இருந்த சவேரிநாத பிள்ளை கிறிஸ்தவராக இருந்தாலும்

விபூதி அணிந்து கொள்வார். திருப்பெருந்துறையில் யாவரும் அவரைக்

கிறிஸ்தவரென்று அறிந்து கொள்ளவில்லை. சிவ பக்தர்கள் கூடியிருந்த

அவ்விடத்தில் அவரும் ஒரு சிவ பக்தராகவே விளங்கினார். சைவர்களோடு

பந்தி போஜனம் செய்வதில்லை; தோற்றம். பேச்சு, நடை உடை பாவனைகள்

எல்லா விஷயங்களிலும் அவருக்கும் சைவர்களுக்கும் வேறுபாடே தோற்றாது.

ஆயினும் 'சவேரிநாதர்' என்ற பெயர் மாத்திரம் அவர் கிறிஸ்தவரென்பவதைப்

புலப்படுத்தியது. பெயரிலும் சைவராக இருக்க வேண்டுமென்று அவர்

விரும்பினார்.

 

திருப்பெருந்துறைக்குச் சென்ற சில தினங்களுக்குப் பிறகு தம்

விருப்பத்தை அவர் ஆசிரியரிடம் தெரிவித்துக் கொள்ளலானார். "இங்கே

எல்லாம் சைவ மயமாக இருக்கின்றன நானும் மற்றவர்களைப் போலவே

இருந்து வருகிறேன். என் பெயர்தான் என்னை வெளிப்படுத்தி விடுகிறது.

அதை மாற்றிச் சைவப் பெயராக வைத்துக்கொள்ளலாமென்று எண்ணுகிறேன்.

புராணம் அரங்கேற்றும்பொழுது ஐயா அவர்கள் எதையேனும் கவனிப்பதற்காக

என்னை அழைக்க நேரும். சிவநேசச் செல்வர்கள் நிறைந்துள்ள கூட்டத்தில்

கிறிஸ்தவப் பெயரால் என்னை ஐயா அழைக்கும்போது கூட்டத்தினர் ஏதேனும்

நினைக்கக்கூடும்" என்றார். "உண்மைதான்" என்று சொல்லிய ஆசிரியர்,

"இனிமேல் சிவகுருநாதபிள்ளையென்ற பெயரால் உன்னை அழைக்கலாமென்று

தோன்றுகிறது. உன் பழைய பெயரைப் போலவே அது தொனிக்கிறது" என்று

நாம கரணம் செய்தார். சவேரிநாத பிள்ளைக்கு உண்டான சந்தோஷம்

இன்னவாறு இருந்ததென்று சொல்ல இயலாது.

 

சவேரிநாதபிள்ளை குதித்துக் கொண்டே என்னிடம் ஓடி வந்தார்.

"இங்கே பாருங்கள்; இன்று முதல் நான் முழுச்சைவன். என் பழைய பெயரை

மறந்து விடுங்கள். நான் இப்போது சிவகுருநாதன். உங்களுடைய வைஷ்ணவப்

பெயரை மாற்றிச் சாமிநாதனென்று ஐயா வைத்தார்களல்லவா? அந்தப்

பாக்கியம் எனக்கும் கிடைத்தது. என் கிறிஸ்தவப் பெயரை மாற்றிச்

சிவகுருநாதனென்ற பெயரை வைத்திருக்கிறார்கள். ஆசிரியர் நம் இருவரையும்

ஒரே நிலையில்வைத்து அன்பு பாராட்டுவதற்கு அடையாளம் இது. இரண்டு

பேர்களுக்கும் அர்த்தம் ஒன்றுதானே? சாமிநாதனென்றாலென்ன?

சிவகுருநாதனென்றாலென்ன? இரண்டும் ஒன்றே" என்றார்.

HC dismisses PIL against temple tower image in TN Govt emblem

 

Madras High Court today dismissed a PIL against the inscription of a temple tower in the Tamil Nadu government emblem.

Just because temple tower was inscribed in the emblem, it cannot be said the state government was giving preference or encouraging a particular religion, First Bench comprising Acting Chief Justice R K Agrawal and Justice M Sathyanarayanan ruled.

The court also rejected another prayer of petitioner R Kannan Govindarajulu that the national flag depicted in the emblem should be rearranged to meet prescribed norms.

The petitioner had sought a direction to replace the image of temple tower and rearrange the national flag to its correct specifications in the emblem.

The Judges said no finger has been raised with regard to any preference by the state government in favour of any particular religion.

On the prayer related to national flag, they said none of the provisions of The Emblems and Names (Prevention of Improper Use) Act, 1950 and Flag Code of
India, 2002 had been violated.

Respect and dignity of the national flag had been preserved in the state emblem and therefore, it cannot be said the display was against provisions of the above act, the court said and dismissed the PIL.

CHENNAI: Has the Tamil Nadu government been committing any constitutional blunder by having the Srivilliputtur temple's tower flanked by the national flag as the state emblem? No, the Madras high court has ruled.

Rejecting a public interest petition which said that by having a temple tower in its emblem the state government was violating the secular values enshrined in the Constitution, the first bench said: "It cannot be said that since the emblem of the government of TN is having a temple tower, it is giving preference or encouraging a particular religion."

The bench comprising acting Chief Justice R K Agrawal and Justice M Sathyanarayanan was passing orders on a PIL filed by ex-serviceman R Kannan Govindarajulu of Kancheepuram.

In his petition, he cited two 'flaws' in the Tamil Nadu state emblem. One, it had a religious symbol - a temple tower. Two, the national flag image in the emblem was not in accordance with the proportion laid down in the Prevention of Insults to National Honour Act, 1971.

The bench, however, rejected both the arguments saying there was neither disrespect to the tricolour nor anything favouring any particular religious group. So far no accusing finger had been pointed towards the TN government with regard to preference for a particular religion, it said.

As for the national flag, the judges said the provisions of the Emblems and Names (Prevention of Improper Use), Act, 1950 and the Flag Code of India, 2002 were regulatory in nature and impose only reasonable restrictions. Agreeing that the Flag Code should be followed to preserve the dignity of the tricolour, the judges said: "In the state emblem, the national flag finds a prominent place. This court is of the view that the length-to-breadth ratio is applicable only if the flag is displayed. This court is also of the view that respect and dignity of the national flag has been preserved in the state emblem, and therefore, it cannot be said that the said display is against the provisions of the Act and the Flag Code."
